California doctor jailed for 15 years over $45m Medicare Botox fraud
A California doctor has been jailed for 15 years after billing Medicare, the United States’ public health insurance programme, more than $45 million for Botox injections that were never given or were not medically needed.
Violetta Mailyan, 45, of Glendale, owned and ran the Healthy Way Medical Center. She was sentenced on Thursday, 29 October, after a jury found her guilty in May following a six-day trial. She was convicted of nine counts of wire fraud and three counts of obstructing a criminal investigation into a health care offence.
Prosecutors said Medicare only pays for Botox when it is needed to treat documented chronic migraines. Mailyan billed for thousands of injections that were never provided, were given only for cosmetic reasons, or were given to patients who had not been referred for migraine treatment. More than $19 million was billed for injections given on days when the clinic was closed, and she billed more than $200,000 while she was on holiday in Cabo, Mexico.
When investigators closed in, she tried to hide what had happened by falsifying medical records and forging patients’ signatures, including for a man who was in federal prison at the time she claimed to have treated him. She spent the money on luxury goods, including two Tesla cars, one a Cybertruck, five properties in California, a $12,000 17th-century crossbow and a $3,000 painting. The court also ordered her to pay about $32.9 million in restitution to Medicare and to forfeit more than $16 million in assets.
Why it matters
The case is a reminder that public health money is a target for fraud, and that billing records can be checked against simple facts, such as whether a clinic was open or a doctor was in the country. The judge called the fraud “truly breathtaking in scope and shocking in its duration”, and said her actions were “almost unbelievable in their brazenness”.
What happens next
Mailyan will serve her 15-year prison sentence, and the United States said it will pursue the return of the stolen funds. The case was investigated by the FBI and the health department’s inspector general, and prosecutors said the wider crackdown on health care fraud will continue.
